Probate Estate Planning & Wills and Trusts include the planning of one’s estate so that your wishes are accomplished, during your lifetime and after.  It can also include the drafting of powers of attorney, durable powers of attorney, living wills, and durable powers of attorney for health care, etc.   I like to compare the drafting of wills, etc. with plumbing that gets you your desired hot or cold water, and not sewage when the instruments are poorly drafted.  Otherwise, you may get unplanned legal results not to your liking that actually occur due to statutory legal presumptions or your unstated or misstated intent.

My focus is making sure you are ready for any eventuality.  Sometimes intestacy (non-will) laws established by the state will fulfill your probate wishes, but do you have the legal confidence of that?   I find it is better to consult with an attorney to get the confidence that your desires will be accomplished in  or out of probate court.  You can sleep easier.  A will can also save a lot of court fees and unnecessary post-death legal work and costs.

The administration of a probate estate can be complicated, or not.  There are many issues to be resolved in an estate.  You at least owe it to yourself to make sure to consult with an attorney to see what needs to be done.
